This practice group convinced the Supreme Court of Rhode Island to find that the plaintiff did not use due diligence in filing a claim for medical malpractice outside the statute of limitations.

Attorneys from this practice group were the first to aid the Supreme Court in the interpretation of the statute of limitations change pertaining to legal malpractice actions. We were able to obtain a decision for our client on the basis that the plaintiff should have known of the alleged negligent activity at a point in time that fell outside the newly enacted statutory period.
