In a case against a municipality for injuries due to the alleged negligent operation of a municipal beach, advocates from this practice group successfully argued to the Supreme Court that the enforcement of town traffic ordinances did not give rise to a special duty to the individual plaintiff over the general public. Therefore, the Court found the Public Duty Doctrine barred plaintiff's suit.

Members of this group successfully defended an electric utility in a negligence action against an electric utility company where the plaintiff made a claim of negligence due to the failure to insulate the primary distribution wire. Attorneys from this group convinced the Court that our client had met all applicable standards concerning the installation of such a wire, and that the plaintiff offered no evidence that would allow a reasonable jury to find any negligence.
